  • A Termination clause will inform that users’ accounts on your website and mobile app or users’ access to your website and mobile (if users can’t have an account with you) can be terminated in case of abuses or at your sole discretion.
  • A Governing Law will inform users which laws govern the agreement. This should the country in which your company is headquartered or the country from which you operate your web site and mobile app.
  • A Links To Other Web Sites clause will inform users that you are not responsible for any third party web sites that you link to. This kind of clause will generally inform users that they are responsible for reading and agreeing (or disagreeing) with the Terms and Conditions or Privacy Policies of these third parties.
  • If your website or mobile apps allows users to create content and make that content public to other users, a Content section will inform users that they own the rights to the content they have created.
    The “Content” clause usually mentions that users must give you (the website or mobile app developer) a license so that you can share this content on your website/mobile app and to make it available to other users.
    Because the content created by users is public to other users, a DMCA notice clause (or Copyright Infringement ) section is helpful to inform users and copyright authors that, if any content is found to be a copyright infringement, you will respond to any DMCA take down notices received and you will take down the content.
  • A Limit What Users Can Do clause can inform users that by agreeing to use your service, they’re also agreeing to not do certain things. This can be part of a very long and thorough list in your Terms and Conditions agreements so as to encompass the most amount of negative uses.

The Customer is taken to have exclusively accepted and is immediately bound, jointly and severally, by these terms and conditions if the Customer places an order for or accepts delivery of the Goods. DELIVERY OF GOODS 1. The Customer must arrange to personally collect the Goods at HP’s address or arrange for the Goods to be collected by the Customer’s nominated carrier service. HP may, on the Customer’s request, arrange for the Goods to be delivered by HP or HP’s nominated carrier service, which will be at the Customer’s cost and added to the Price. 2. It is the responsibility of the Customer to ensure that access is suitable to accept the weight of laden trucks. 3. The Customer should understand as well that the Standard Delivery is just a CURBSIDE Pallet Off loading. 4. Any time or date given by HP to the Customer is an estimate only. The Customer must still accept delivery of the Goods even if late and HP will not be liable for any loss or damage incurred by the Customer as a result of the delivery being late. 5. Standard delivery will take anywhere between 3-10 days. DEFECTS, WARRANTIES and RETURNS 1. The Customer must inspect the Goods on delivery and must within seven (7) days of delivery notify HP for any evident defect/damage, shortage in quantity, or failure to comply with the description or quote. 2. If HP is required to replace the Goods. But if is unable to do so, HP may refund any money the Customer has paid for the Goods. 3. Returns will only be accepted provided that: HP has agreed that the Goods are defective; The Goods are returned within a reasonable time at the Customer’s cost (if that cost is not significant); and the Goods are returned in as close a condition to that in which they were delivered as is possible. 4. HP shall not be liable for any defect or damage which may be caused or partly caused by or arise as a result of: The Customer failing to properly maintain or store any Goods; The Customer using the Goods for any purpose other than that for which they were designed; fair wear and tear, and any accident. 5. HP may in its absolute discretion accept non-defective Goods for return in which case HP may require the Customer to pay handling fees of up fifteen percent (15%) of the value of the returned Goods PLUS any freight costs. CANCELLATION 1. HP may cancel any contract to which these terms and conditions apply or cancel delivery of Goods at any time before the Goods are delivered by giving notice to the Customer. On giving such notice HP shall repay to the Customer any money paid by the Customer for the Goods. 2. In the event that the Customer cancels delivery of Goods the Customer shall be liable for any and all loss incurred by HP as a direct result of the cancellation (including, but not limited to any loss of profits). 3. In the event that a Customer cancels an order, the Customer shall shoulder a cancellation fee of 15% of the order amount. The cancellation fee will be for the costs incurred in packing the items for shipping/transport/pick-up and unpacking these again to return to our warehouse (since the order has been cancelled) and for the cancellation processing fee with the bank. RISK 1. If the Customer requests HP to leave Goods outside HP’s premises for collection or to deliver the Goods to an unattended location then such Goods shall be left at the Customer’s sole risk. 2. The Customer acknowledges that Goods (Masonry Products and Natural Stones) supplied may: a. exhibit variations in shade, colour, texture, surface, finish, markings and may contain natural fissures, occlusions, lines, indentations and may fade or change colour over time; and b. expand, contract or distort as a result of exposure to heat, cold, weather; and c. mark or stain if exposed to certain substances and be damaged or disfigured by impact or scratching.
